Mediation

West Coast Resolution Group, Inc.

Conflict is an inherent aspect of life, and mediation serves as an effective tool for managing it. At West Coast Resolution Group, our mediators, Nichola Krebsbach and Jordan Brown, are adept at understanding the root causes of conflicts and guiding parties from adversarial stances toward constructive change and resolution. We facilitate a constructive environment for addressing challenging issues, encouraging honest dialogue about the strengths and weaknesses of the case, the potential risks and benefits of litigation, and fostering openness to mutually agreeable solutions.

West Coast Resolution helps parties “do conflict” better. We use a dual-mediator model, working as a team to find solution. We are compassionate, yet candid and direct. We are committed to exploring every avenue of resolution by having honest discussions with the parties, while listening respectfully and “hearing” all sides. We emphasize a facilitative approach to mediation, focusing on cooperation over competition while assisting parties to work toward peaceful resolution.

What is Mediation?

Mediation provides an alternative method of resolving complaints without having to go to court. Through the mediation process, the parties work out their own solutions with the help of a mediator. The mediator does not enforce a decision on the individuals, but helps guide them in reaching a solution. The parties play active roles in resolving the problem, and are usually comfortable and supportive of the solution.

Successful mediations often result in written agreements that are signed by both parties. If the parties do not reach a mutually agreeable solution, either or both of the parties may still file a court action.  The mediator’s role is to work with both parties to identify the issues, reduce misunderstandings, clarify priorities, vent emotions, find points of agreement, explore new areas of compromise, and negotiate an agreement.

When to Mediate

Mediation is a non-adversarial way to resolve disputes regarding a variety of workplace and family issues:

Employment, sexual harassment, shareholder disputes, wage and hour, contract, family businesses, divorce (child rearing arrangements, child support, spousal maintenance, dividing of property and debt, etc.), cohabitation and non-marital parenting, estate planning, care of elderly family members, probate of estates and trust administration
